Difference between executor and administrator?
Executor appointed by will; Administrator appointed by statute.
What is a grant of representation?
Court order confirming authority of PRs to administer estate.
Which court issues a grant of representation?
The High Court.
What does grant of representation establish?
Authority of PR, validity of will, or confirmation of intestacy.
Does PR have authority over joint tenant property?
No.
When can an executor begin acting?
From date of death; grant confirms existing authority.
When can an administrator begin acting?
Only once the grant is issued.
Is it advisable for executors to act without grant?
Usually best to wait for grant of representation.
