A

What is burglary?

A

9(1)a if he enters a building or part of a building as a trespasser with the intent to commit theft, inflict GBH or commit unlawful damage.

9(1)b a person enters as a trespasser and has stolen or committed GBH. The offender will be guilty whether they intended to cause harm when they entered or not.

Sentencing for burglary

A

Either way offence

BUT … if the building is a dwelling = CROWN COURT, maximum = 14 years.
Non dwelling maximum = 10 years

Magistrates = max 6 months and/or fine.

3 strikes - minimum 3 years imprisonment.
