Q

How do you negotiate a licence fee for third party access where there have been legacy issues

A

I would speak with those involved in prior issues to understand what these were and how they may have been resolved previously. I would then arrange to meet with the landowner or have a phone call to explain the requirements and ask them to raise any concerns they have to try and mitigate them

Q

At Idmiston, why didn’t you propose a licence fee and justify why you were offering the figure?

A

By allowing the landowner and their agent to outline their position, it enabled me to understand if they were seeking an unrealistic amount before incurring too much time preparing an offer. It also enabled the opportunity of the landowner requesting a figure lower than what my client would usually be willing to pay.
