Since13thNovember 2017, defendants have beenaskedto provide their nationalityas part of theinformation requirements of a criminal hearing (introduced under section 162 of the‘Policing and Crime Act 2017’).I have been volunteering for Commons as part of a research project that examines the impact of this requirement on the way defendants are treated in magistrate courts. Commons have observed a subconscious apprehension towards BAME defendants that seems to substantiate DavidLammy’s(amongst others’) claim of continuing racial prejudice in our ‘impartial’ criminal justice system.We live in a society where nationality is aprivilege.Thisprivilegecomeswitha flexibility in self-identification. However, for a defendant to be expected to reduce an often-complex issue of self-identity in the pressured environment of a criminal hearing advantages the whiteBrit, self-assured oftheirnationality. Indeed, I have observeddefendantsfrequently conflateethnicity and nationality, particularly amongst those who are less confident in their English. This communication barrier can not only impact the way in which the magistrates’ bench respond to the defendant, but can also leave the defendant feeling confused andunnerved.It can seem like an attack on the ‘other’, perpetuating a sense of alienation amongst our multinational community.I believe that the nationality question demands serious attention.The impact of a defendant’s response on their judgmentnotonlyexposesdeeply-rooted prejudice,but also contributes to a feeling of hostility amongst, often, the most vulnerable groups in society.

  • English criminal courts do not systematically collect information on nationality of defendants and, according to magistrates and judges I interviewed, rightly so because immigration and citizenship should not be a consideration for criminal justice adjudication.
  • My job involved examining whether the nationality question was asked at all and if so, how the defendant responded to it
  • In many cases, it was not asked. This was still valuable for the research as I was then required to ask the court usher about it. More often than not, they were not aware of its implementation
  • I did have one instance where the question was asked and the defendant seemed to conflate nationality and ethnicity
  • Improved research skills, my familiarity with the structure of court hearings
  • Also made me question my own opinions on the concept of nationality
