Case Law

Published legal decisions decided in a court of law by a judge or jury.

Remand

The act of sending an appealed legal case back to trial court to determine an issue of fact.

Summary Judgement

A written document (motion) produced by attorneys and brought before the court claiming that a case should be decided based on a on the applicable law, given that no facts remain in dispute.

Laws (legislation or codes) created by legislators at the state and federal levels.

Period of Discovery

The formal process of exchanging information between the parties about the witnesses and evidence they’ll present at trial.

Refers to the duty of the person responsible for proving the case.
