What is the Policy for General Order 300-28 Use of Intoxicants?

Employees shall not use, purchase, consume,
or transport intoxicants in a manner
prohibited by this General Order

Alcoholic Beverage Establishment

Any place at which the primary purpose is the
sale of alcoholic beverages or 51 percent
or more of its income is from the sale of
alcoholic beverages for on-premise consumption.

This also includes rental or temporary facilities where alcoholic beverages are sold, served, or consumed and
the location charges a cover charge or
entry fee.

Intoxicated.

Intoxicated as defined by Section 49.01 of the Texas Penal Code.

Intoxicant

Any drug, medicine, alcoholic beverage, or substance that affects the normal use of mental or physical faculties.

Under the Influence of Alcohol.

Having any measurable concentration of alcohol
in one's blood, breath, or urine.

RESTRICTIONS FOR ALL EMPLOYEES

Employees shall not:

A. Consume any alcoholic beverage regardless of assignment (plainclothes or uniform) while on duty (see section 3).

Officers shall not exercise police authority
while under the influence of intoxicants
whether on or off duty.

EXCEPTIONS

Division commanders may make reasonable
exceptions to section 1 of this General Order if the normally prohibited behavior falls within the scope of the employee's duties or responsibilities (e.g.,
undercover vice operations at alcoholic
beverage establishments).

Such exceptions must be documented in the division's
standard operating procedures manual and monitored by the division captain.
