Explain Sharia Law as a form of “Derecho Omnipresente”

A
  • Sharia (Islamic Canonical Law) is based on the teachings of the Q’ran and prohibits certain activities such as acceptance of specific interest which is considered usury or investments in businesses contrary to Islamic acceptance (i.e. alcohol)
  • Regarding family law, it is in the traditional understanding that it’s the father’s responsibility to ensure his children, as well as his wife, receive proper religious education.
  • If the father can bring into suggestion the morality of the mother, then the law can shift to be in his favor.

A

EL DF está ligado a la figura del padre, las normas patriarcales establecidas en el Corán regulan el matrimonio, la filiación y la herencia.

MATRIMONIO

  • es un contrato entre contrayentes aptos para consumarlo (el hombre debe ser musulman, la mujer no puede casarse con un no-musulmán)
  • El Corán establece un máximo de 4 esposas, pero no pone límite a las concubinas
  • La esposa debe prestación conyugal y obediencia
  • Cada cónyuge es administrador de sus bienes con independencia del otro, el matrimonio no produce ninguna comunidad de bienes
  • Se disuelve por repudio o divorcio

FILIACIÓN

  • Siendo pecado toda relación sexual fuera del matrimonio o concubinato..
  • El derecho islámico solo reconoce la filiación legitima
  • Ignora la legitimación, adopción y reconocimiento de hijos ilegítimos

  • It is Digital currency which is used and distributed electronically. It is a decentralized peer to peer network, since no single person or institution controls it. There is no way to print it and the amount of bitcoins is very limited.
  • The main advantage of bitcoin is its independence from governments, banks and corporations. NO authority can interfere into BTC transactions or impose fees. Every single transaction is stored in a massive distributed public ledger called the Blockchain.
  • It is forbidden, according to Shair Shawki Allam (Grand Mufti of Egypt), after he issued a fatwa condemning cryptocurrencies
