What does socially constructed mean
Something has been created by society, that is not natural. We know things are a social construction when they change through history, in different parts of the world and for social groups.
Are crime and deviance socially constructed
Having a fight on the street is seen as deviant but in a boxing ring it is a sport
Killing Someone may be interpreted as heroic, manslaughter, self-defence, murder, crime of passion or euthanasiam
How have laws changed over time
Laws change over time due to a range of factors this could be because norms and values change, because of societal pressure and media coverage of issues
E.g the law regarding the double jeopardy which was a result of Ann Mings campaign, since 2003 a person can be tried twice if there is “new and compelling evidence” This has led to the successful prosecution of Gary Dobson and David Norris for the murder of Steve Lawrence
How have laws changed between cultures (one example)
Adultery- A sexual relationship between a married person and someone who is not their spouse
Not considered a criminal offence but may have legal offences in divorce proceedings
Legal in Uk and all other European cultures
Illegal in many countries governed by Islam law such as Saudi Arabia and Pakistan
Varies in different cultures due to religion because the bible states that adultery is a sin
How have laws changed over time between cultures (second example)
Homosexuality-involving or characterised by sexual attraction between people of the same sex
Once it was illegal but was partially decriminalised in 1967 with the age of consent, ie to participate legally In sexual relations, was set at 21 years , the age of consent was lowered to 18 and then 16. Initially, civil partnerships were allowed and now same sex marriage can also take place.
Legal in UK, Europe, USA and Canada
Illegal in India, Saudia Arabia
Religion is a major reason for why the law varies in different countries
