It has the following three elements:
One – The accused deprived another person of his or her liberty;
Two – The accused intended to deprive that person of his or her liberty; and
Three – The deprivation of liberty was unlawful.
Crook enters toilet block and tells victim that they can not leave the toilet block. Crook has deprived that person of their liberty, they intended for that person not to leave.
