What is an indictable vs a non-indictable offence?
Indictable offences must come to trial with a jury: crimes and misdemeanours
Non-indictable offences heard in a magistrates court with no jury: simple and regulatory offences
What are the elements of homocide?
‘the unlawful killing of another’
1. killed: causing death directly or indirectly
2. another person: must be a living person and does not include unborn babies
3. unlawfully: considered unlawful if there is no excuse, defence, justification or authorisation
What are the elements of murder?
All the elements of homocide and one of:
4A. an intention to kill or do grevious bodily harm
4B. the accused did an act that was likely to endanger life and the victim died as a result of that act
What is the penalty for murder?
life imprisonment - cannot be mitigated or varied
What are the elements of manslaughter?
‘the unlawful killing of another in circumstances that do not amount to murder’
occurs when the prosecution cannot prove intention
can occur when there is criminal negligence
What are the elements of stalking?
- involves a repeated conduct such as following, watching or sending messages that gives rise to the victim fearing for their personal safety.
- the punishment can be increased if violence, threats or a weapon is used
- the court may issue a restraining order

1. an ordinary person would consider the act dishonest
2. the accused subjectively knew what they were doing was dishonest
