Advance Directives (‘Living Will’)

A

A legally binding document outlining what medical treatment a patient would not want in the future, if they lack capacity.

Signed and witnessed.

Relatives have no rights.

The patient cannot specify what treatments they want, only what they don’t.

Lasting Power of Attorney

A

A third person is appointed (in advance) to make decisions on the patient’s behalf should they come to lose capacity. It may be one person or more than one person acting jointly.

  2. Property and finance affairs

£130 for each type

A
The third party can make decisions about:
Daily routine
Medical care
Moving into a care home 
Refusing life-saving treatment 

Has a right to refuse offered medical treatments but not to choose which treatments to have. Only takes effect when the patient lacks capacity.
