Regulation of Professions by Department of Health
A
- Profession means any activity, occupation, profession, or vocation regulated by the department in the Division of Medical Quality Assurance.
- Intent is to regulate for health, safety, and welfare of public
- biennial licenses, or up to a 4-year license
- board meets at least once annually, quorum needed (51% of board members)
- board members get $50 a day for attendance or participation

A
All can be made public except:
1. financial info
2. medical info

Limited Licenses for Professions
A
- Retired professionals in good standing who serve indigent, underserved, or critical need populations
- application and fee not to exceed $300, waived if pro bono only
- must have practiced in the U.S. for at least 10 yrs

Eligibility for Licensure as Health Care Practitioner in Florida
A
- serves or served as such in US Armed Forces, Reserves, or Nat’l Guard
2. served active duty in military in US Public Health Service
3. Is a health care practitioner in another state, DC, or a territory, or is spouse of active duty - application fees are waived
- must have practiced for 3 years prior to application

Ineligible for Licensure in Florida
A
- convicted or pled no contest to felony or misdemeanor in practice of health care profession
- has had health care license revoked or suspended
- has been reported to National Practitioner Data Bank (not if appealed)
- has previously failed the Fl exam

Temporary Certificate for Active Duty Health Care Practitioners
A
- “Military health care practitioner”
- active duty or in US Public Health Service
- practices in “military platform”
- holds license in other state, DC, or territory or if license isn’t required to practice in the military
- good for 6 months
- fees not to exceed $50, renewal $50 also (determined by rule)
- wall certificates fee not to exceed $25
- 1 assessment fee allowed in 4-year period

Controlled Substances Prescribing
A
- requires registration with US DEA
- complete board-approved 2 hr CE course on it

A
- required of all licensee of all professions
- 2 hours CE course every 3rd biennial (6 yrs)

A
- Div. of Medical Quality Assurance has authority
- rebuttable presumption that illness was contracted via employment, must have reported it; can be challenged by employer

- required biennially for renewals

Human Trafficking
A
- licensee must complete 1 hour of CE on human trafficking (sex and labor)
- licensee must display a sign 11x15, 32-pt type with National Human Trafficking Resource Center info

Reactivation after retiring
A
- inactive Status for more than 2 consecutive biennial cycle may be required to decmonstrate competency

Requirements of Professional seeking licensure
A
- must provide medical school info
- info on all graduate medical education
- name of each hospital where has privileges
- address of practice
- specialty board certificates
- year of beginning practice
- appointment to faculty of medical school
- criminal offenses if guilty or no contest plea (felony or misdemeanor)
- any disciplinary actions in previous 10 yrs
- must update board within 45 days of any new event impacting status ($50/day fine for non-compliance)
- fingerprints to Dept of Health
- publications in peer-reviewed medical lit within past 10 yrs
- professional or community service activities/awards
- languages spoken
- Medicaid participation

Psychiatric Records
A
- Psychiatric, psychological, psychotherapeutic record
- may provide a report of exam and tx in lieu of copies of records
- if patient’s makes a written request for complete copies, records shall be provided directly to subsequent treating psychiatrist
- cannot be contingent upon a fee

Health Care Records Privacy Exceptions
A
- patient has provided consent
- compulsory physical exam under Fl Rules of Civil Procedure - to defendant and plaintiff
- subpoena for civil or criminal action
- for stats or scient. research, without identity or with consent
- to a regional poison control center for tx
- to Dept of Children & Families or its agents
- for investigation of vulnerable adults
