R v Zerei 2012

A

D and another man approached V who they knew and told him they were going to take his car. D then pulled a knife, punched V and took his keys and drive car off. Car was found abandoned 1km away. D’s conviction of robbery was quashed as was an issue of intention to permanently deprive. (Theft wasn’t completed so couldn’t be robbery)

R v Dawson and James 1976

A

One of D’s pushed the victim, causing him to loose balance enabling other D to take his wallet. Convicted of robbery. Court held it was for jury to decide if ‘force’ occurred

B & R v DPP 2007

A

V was stopped by 5 boys they asked for his phone and money. Then another 5 joined and surrounded him. No serious violence was used against V but he was pushed and he was searched. Convicted of robbery
D doesn’t have to be frightened and amount of force doesn’t have to be great.

R v Hale 1979

A

The D’s forced way into Vs house. One put hand over V’s mouth to stop screaming while other went upstairs and took jewellery. Before leaving house they tied V up.
Force immediately before or at the time of the theft.
(Tying up V could be force in order to steal, as the theft was still ongoing)
