Main steps about how a bill becomes a law

A
  1. A bill is born. Anyone can draft a bill but only members of the legislature can introduce a bill.
  2. Committee action. As soon as a bill is introduced, it is referred to a committee. The bill is examined carefully and it’s decided if it can move onto its appropriate committee or becomes effectively “dead.”
  3. Subcommittee review. Sent here for studies and hearings. Anyone can speak. changes can be made (mark up)
  4. Voted on by subcommittee
  5. Voted on by full committee on its recommendation to the house or senate. This procedure is called “ordering a bill reported.”
  6. Voted on by respective chamber (either house or senate).
  7. Referral to the other chamber. Follows the same route through committee and floor action. This second chamber may approve as is, reject it, ignore it, or change it. Both the house and the senate must approve.
  8. Conference committee action between the two chambers. Occurs when the other chamber significantly alters the bill.
  9. After both the house and senate have approved, it is sent to the president. If the president signs, it becomes a law.

What does “ordering a bill reported” mean?

A

Committee action to report a bill.

After receiving a subcommittee’s report on a bill, the full committee votes on its recommendation to the house or senate. Once done, the bill is available to be considered by the full body of the respective chamber (house or senate).

What is a conference committee action and why do you not want it to happen?

A

After one chamber reviews a bill, it is passed onto the other chamber. If the other chamber significantly changes the bill, there must be a conference between the two chambers to discuss.

It gets messy here. Difficult to manage, amendments can be made, and restrictions added.

A

Composed of senior members of the standing committees of each house that originally considered the legislation.

A

It automatically becomes a law. Some presidents will do this if they don’t specifically agree with the law, but know it is best for the public.

A

If the president vetos a bill, the legislature may attempt to override the veto. If BOTH the house and senate pass the bill at a two thirds majority, the presidents veto is overruled and the bill becomes a law.

A

It is called a “pocket” veto. This means that the legislature dies. A veto without signing.
