A
  1. The officer must lawfully make an initial intrusion or otherwise be in a proper position from which he can view a particular area.
  2. It must be immediately apparent that the items observed may be evidence of a crime, contraband, or otherwise subject to seizure. Immediately apparent as evidence meets the probable cause requirement for seizure.
