What does searches under s 1 (of the PACE Act 1984) refer to?
The powers an officer has to stop and search any person.
Under this legislation, an officer must have reasonable grounds to suspect that the person may be in possession of any stolen or prohibited article.
What items are included in s 1?
For stolen or prohibited articles.
The officer should have reasonable grounds to suspect this- could be intelligence, personal knowledge of a person, time of day and location.
Prohibited articles include bladed or sharply pointe items, fireworks, offensive weapons or items which could be used in criminal offences.
The location of a search under s 1 (of the PACE Act 1984)?
Can be conducted anywhere consiered a public place.
Many vehicles.
Anything inside vehicle also.
Under NO circumstances can a search be undertaken within a dwelling even if they’re an intruder (only in garden as an intruder).
