When is an EPC required?

A
  • Must be commissioned within 7 days of marketing
  • Newly built, sold or let for a term greater than 6 months (&less than 99 years)
  • Sub-letting or assignment of lease
  • When newly refurbished and heating, a/c or ventilation services are altered and/or the building is subject to Building Regulations for construction/changes
  • From 1st April 2023 all existing leases on commercial buildings require an EPC

What are the exemptions for MEES?

A
  • If a building does not need an EPC
  • Industrial units with low energy demand (no heating/cooling)
  • Where tenancy less than 6 months with no security of tenure
  • Where the tenancy is more than 99 years
  • 7-year payback period (3 quotes for works)
  • Works proven to devalue the building by more than 5%
  • Exemptions last for 5 years and are not transferable on sale
  • Exemptions must be registered with local authority and renewed every 5 years.

  • Rule of conduct 3 – Provide a high quality and diligent service including advising your client on sustainable solutions where most appropriate.
  • Rule of conduct 5 – act in the public interest, take responsibility and act to prevent harm
  • RICS Valuation – Global Standards 2021 VPGA8 – valuers should be aware of sustainability features and the implications these could have on property values short, medium and long term
  • Advising clients to seek specialist advise when out of the surveyors area of competence

What is the link betweeen biodiversity and net-zero carbon?

A
  • Increased biodiversity increases the amount of carbon dioxide naturally absorbed and stored, therefore taking it out of the atmosphere. Reduction of carbon .

What are some clauses that may be added to a green lease?

A
  • Data sharing – landlord and tenant will share environmental related data they hold relating to the premises
  • Service charge – cost of auditing the Environmental Performance of the Building to be included. Where in interest of good estate management and cost effective to do so, implementing recommendations from environmental management plan (dependant on length of lease)
  • Alterations – No alterations to reduce building EPC
  • Landlords rights to do works – landlord may measure tenants energy and wate use and carry out works intended to improve Environmental Performance of the building (little disruption and plenty of notice)
  • Ethical exclusion policies on alienation (sanctioned individuals/fossil fuel companies)
  • Rent review – ensure specification attached to lease reflects demise only so landlords improvements can be valued.
  • Reinstatement – landlords discretion tenant may not be required to reinstate lawful alterations that would adversely affect Environmental Performance of the building.
