Civil law- Handles offenses against individuals; civil dispute
Criminal law- Handles offenses against society; government prosecution
Intent vs Motive
Intent- Did they intend to act out; was it premeditated?
Motive- The reasoning behind the crime
Crime
An act or failure to act that society says must be punished
Actus Rea
The action/ conduct of the accused
Mens rea
The intention or knowledge of wrong doing
Affidavit
Sworn statement/ oath
Affiant
Present evidence to the judge
Probable Cause
Evidence that a crime has been, will be, or is being committed
Plea
Formal Statement made by the defendant in regards to their innocence- “Guilty or Not Guilty”
Verdict
Courts determination if a defendant is Guilty or Not Guilty
Defense
Information used to negate charges
