What is the difference between disclosure and inspection?

A

Disclosure is the process b y which a party informs another party that they possess a particular document.
Inspection refers to the right of the other party to read or receive copies of a document that has been disclosed.

How to determine whether a document needs to be disclosed by one party to another?

A

Need to consider the following:
- What is a party obliged to disclose?
- Is the document within the party’s control?
- Does the party have the ability to prevent another party from inspecting the documents?
