what is a wrongful death action?

A

if a decedent dies as the result of a tortfeasor’s wrongdoing, the personal rep of the estate may bring a cause of action agains the wrongdoer on behalf of the beneficiaries of the estate

A

not on the damages suffered by the decedent, but on the damages suffered by the family or beneficiaries of the decedent’s estate; so not entitled to the pain the decedent went through

the will has no bearing on the beneficiaries, and instead the beneficiaries are established by statute, which prioritizes people who are closely related, then those more remotely related

what should we be looking for when reading the facts of a wrongful death case on the exam?

A

to make sure the decedent died from the tortious act of the def. if he did not (ie died from natural causes), then there is no wrongful death claim, but instead a personal injury claim that survives and can be brought by the fiduciary of the estate

A

law claim that litigates the right to possession of, not title to, real estate

A

-rent
-damages for the wrongful detention of the premises, and
-an order for the def to move out, or face eviction by the sheriff

A

5 days’s notice to pay before obtaining an order for the tenant to vacate the property

A

there is no limit for any claim, counterclaim, cross-claim, or appeal in an unlawful detainer action

A

yes a losing litigant has a right to appeal to cc. the appeal must be noted in writing within 10 days, but also the bond must posted for the rent within 10 days of the entry of judgment
