A

EA allowed to construct + maintain a dam or in connection with dam, a fish pass so long as we do not damage the milling power/supply of water to a navigable watercourse.
- section 172(1) of the Water Resources Act 1991 = to enter premises to exercise or perform any power or duty.

Explain your understanding of the Water Resources Act S172?

A
  • WRA 1991 = 1 of the most important pieces of flood defence legislation + sets out the EAs jurisdiction over main rivers, works powers, powers of entry onto land, consenting and enforcement powers.
