Types of Evidence (4)

A

Real: AKA object Evidence

Documentary: Written items physical or electronic. Also includes logs. Must be authenticated by a witness.

Testimonial: Verbal or written testimony given by witness. Written/verbal can also be done through recording during deposition.

Demonstrative: Used to support testimonial evidence. Used to help explain a concept or provide clarification.

Documentary Evidence Rules (2)

A

Best Evidence rule: document needs to be the original and not a copy if possible

Parol Rule: When an agreement is signed between parties it assumes the agreement includes all terms and conditions and that there were no verbal agreements outside of the written agreement.
