- Section 90

A

Requisitioning powers -sect 90

Direct owner of any land/building/vehicle/animal/boat/apparatus/earth moving equipment, bedding/furniture etc to immediately place that property (requisitioned property) under the Controller/constables control.
- Provide written statement to property owner that the property is being requisitioned and to whos control it is now under.
- if no owner present constable can assume immediate control of the property. provided written statement to owner ASAP when found.

- Section 91. Power to give directions

A

Constable/controller anyone authrosied by them when SOE in force, may:
1) - Direct any person to stop and activity that may cause or contribute to the emergency. (verbally or in writing).
2) - Direct the owner of a structure to obtain an assessment of the effect of the emergency on that structure.
3) Direction under 2 can only be given if there is a belief the structure may pose a threat to life/injury/safety etg.

anyone given a direction under 2 must obtain an assessment in accordance with the direction and at the owners expense. then provide report to the person who requested it.

While a SOE is in force a Controller or Constable/person authorised to act by them, may examine, mark, seize, sample, secure, disinfect, or destroy any property, animal or any other thing to prevent or limit the emergency.

OFFENCES.

A

Section 95 - Offence committed when intentionally fails to comply with requirement in a civil defence emergency management plan.

Section 98 - Offence committed if someone’s threatens/assaults/obstructs etc anyone exercising powers/duty under CDEM act.

Section 104 - Penalty 3 months imprisonment, $5000 fine or both. Body corp $50,000 fine.
