How to establish malice

A
  1. intent to kill: D acts with purpose to kill another or with knowledge that their conduct will kill another
  2. Intent to inflict serious bodily harm: conscious desire or substantial certainty that the D’s actions will result in victim’s injury, including serious or grievous bodily harm that is significant but not fatal injury
  3. Depraved hearth murder: unintended killing resulting from extreme risk created by D that manifests a wanton disregard for human life

  3. Redline limitation (majority/common law): no co-felon liability if police or a victim kills one of the co-felons

A

Requires proof that D’s decision to kill was done with both premeditation and deliberation

A

D must think about the act of killing

Common Law: D can premeditate immediately

Modern Rule: requires some time for premeditation but “brief” is enoug htime to decide with most jurisidctions requiring jury to find that premeditation occured after intent to kill was formed

A

D must make deliberate choice to kill the requires rational thought

A

If voluntary intoxication or diminished capacity is affecting D

What is Voluntary Manslaughter

A

Intentional killing mitigated by adequate provocation or other circumstances negating malice aforethought, including heath of passion

Requirements for adequate provocation

A

Objective standard: provocation that would lead a reasonable person to lose self-control and fly into a sudden homicidal rage

-mere words are not generally enough
-rage must be “hot” such that D hasn’t had sufficient time to cool off

Involuntary Manslaughter

A

Unintentional killing resulting from unjustified risk creation (recklessness or gross negligence) that is not sufficiently extreme to rise to level of implied malice

Requirements for Involuntary Manslaughter

A

D did not intend to kill or expect their conduct to cause death, but death still results from unjustified risk creation that isn’t extreme enough to indicate wanton disregard for human life

Unintentional killing that occurs during the commission or attempted commission of a misdemeanor or non-dangerous felony is automatically manslaughter
