Definition
There are two kinds of harassment:
(1) causing a tangible economic harm (also known as quid pro quo) and
(2) hostile work environment, which doesn’t cause a tangible harm, but consists of an offensive/abusive work environment
Hostile Work Environment Harassment Framework – In order to set forth an actionable claim for hostile work environment harassment, the plaintiff/employee must show:
They are a member of a protected class;
They were subject to harassment in the form of unwelcome verbal or physical conduct;
The harassment is based on the protected class;
The harassment effects the employee’s terms and conditions of employment, such as unreasonably interfering with the work environment and/or creating an intimidating, offensive, or hostile work environment; and
There is a reason to impute liability to the employer
