Usually held soon after the first pre-trial hearing, a preliminary hearing is best described as a “trial before the trial” at which the judge decides whether there is enough evidence to force the defendant to stand trial. In making this determination, the judge uses the “probable cause” legal standard, deciding whether the Prosecution has produced enough evidence to convince a reasonable jury that the defendant committed the crime(s) charged.

Comúnmente se celebra inmediatamente después de la audiencia previa al juicio y su mejor descripción es “un juicio antes del juicio” en el cual el juez decide si existen suficientes pruebas para obligar el procesamiento del acusado. Al tomar esta determinación, el juez utiliza la norma jurídica de “la existencia de un motivo fundado” que pueda convencer a un jurado razonable que el acusado cometió el delito o los delitos que se le imputa.
