A

A contract or provision may be void or voidable if there subject matter or consideration of the contract is illegal.

Application: No bright-line test
- the importance of enforcement balanced by the protection of the public.

Cases:
Huerta v. Strong steel doors
- Illegal immigrants want their wages
- Unclean Hands Rule: Illegality of a contract is relevant when the conduct relied on is directly related to the subject matter in litigation and the party seeking remedy was injured.
