It is an offence for a person to incite another to commit an offence under any other provision of this Act.

A

The offence is punishable as for the substantive offence incited.

Q: Does the offence need to take place?

A

The offence incited need not take place. An incitement still occurs, even though the offence being incited could never take place.
Eg: where an under-cover officer is incited to commit a drugs offence.
