What does EPCRA stand for?
Emergency Planning and Community Right-to-Know Act (aka SARA Title III)
4 Major Provisions of EPCRA?
- Emergency Planning (Section 301-303)
- Emergency Release Notification (Section 304)
- Hazardous Chemicals Storage Reporting Requirements (Section 311-312)
- Toxic Chemical Release Inventory (Section 313)
What does EPCRA do?
Provides specific plans for preparing for, preventing, and responding to the release of over 600 chemicals listed in the Toxic Release Inventory (TRI)
What is the Toxic Release Inventory (TRI)?
Trip tracks the management of certain toxic chemicals that pose a threat to human health and the environment
TRI reports (Form R) are due when?
July 1 of each year
A facility must meet what 3 criteria to be required to report under the TRI?
- Is in a specific industry sector
- Employs 10 or more full time employees
- Manufactures, processes, or otherwise uses a TRI-listed chemical in quantities above the threshold levels in a given year
TRI listed chemicals in general are those that cause one or more of the following:
- Cancer or other chronic human health effects
- Significant adverse acute human health effects
- Significant adverse environmental effects
When are Tier IIs due?
On or before March 1 each year for information on chemicals present at the facility in the previous year
Emergency Planning (Section 301-303)
Local governments are required to prepare a chemical emergency response plan, and to review plans at least annually
Emergency Notification (Section 304)
Facilities must immediately report accidental releases of Extremely Hazardous Substances (EHS)
Community Right-to-Know Requirements (Section 311-312)
Facilities handling and storing hazardous chemicals need to submit SDS to state and local officials (including fire department). Facilities must also submit an inventory form for these chemicals
