What is Forfeiture of Pay and Allowances?

A

FORFEITURE OF PAY AND ALLOWANCES: This deprives the individual of all of a specific amount of money to be accrued (earned in the future) as a result of service in the Armed Forces of the U.S. Unless a total forfeiture is adjudged, a sentence of forfeiture shall state the exact amount of money to be forfeited each month in whole dollars, and the number of months the forfeitures will last.

What is a Reprimand?

A

REPRIMAND: A Reprimand is a severe form of censure that adversely reflects upon the conduct of the person addressed. A Courts-Martial shall not specify the terms or wording of a reprimand. A Reprimand, if approved, shall be issues, in writing, by the Convening Authority. A Reprimand adjudged by a Courts-Martial is a punitive censure.

What is Paying a Fine?

A

PAYING A FINE: The Accused immediately becomes liable to the U.S. For the entire amount of money specified in the sentence. A fine may only be adjudged by a Courts-Martial, and may be adjudged, instead of, or in addition to, forfeiture. However, a fine is normally used only as a sentence in cases where the accuses was unjustly enriched as a result of the convicted offense.

A

REDUCTION TO SPECIFIED LIMITS: Deprivation of normal liberty privileges specified in the sentence in regards to the following:

  • Physical and geographic locations in which the individual is allowed.
  • How long the restriction shall last.
  • When that individual must be present as specific locations.

What is Hard Labor Without Confinement?

A

HARD LABOR WITHOUT CONFINEMENT: Addition duties to be performed in addition to normal duties. Typically, the immediate commander will determine the amount and character of labor to be performed.

A

DISMISSAL: This type of punitive separation is only applicable to commissioned officers, commissioned warrant officers, cadets, and midshipman. It may only be adjudged by a General Courts-Martial. It can be applied for any offense the respective defendant is found guilty of.

A

DISHONORABLE DISCHARGE: This type of discharge is only applicable to enlisted persons and warrant officers who have not been commissioned. It may only be adjudged by a General Courts-Martial abs should be reserved for serious offenses such as convictions of felony behavior or offense of a military nature requiring severe punishment.

What is the third type of Punitive Separation?

A

BAD CONDUCT DISCHARGE: This type of discharge applies only to enlisted persons and may be adjudged by a General Courts-Martial or by a Special Courts-Martial that has met the requirements of R.C.M. 201(F)(2)(B). This type of discharge is less severe than a Dishonorable Discharge and is used as punishment for bad-conduct or repeated minor offenses.
