What are your powers under Section 113 of the Land Transport Act 1998?

A

DIRECT person on a road to give full particulars (full name, DOB, Add, Occ, Ph.

INSPECT, test and examine brakes or any other part of the vehicle, or associated equipment, or LTNZ docs.

MOVE authorise anyone to move the vehicle.

DIRECT the driver to move the vehicle

ORDER an unlicenced driver not to drive. (forbid them), until they obtain correct licence.

DIRECT a pedestrian or driver to go in a particular line or direction (points duty)

A

In uniform, or wearing a cap displaying a badge of authority
- OR -
In a vehicle, including plain clothes may stop a vehicle by using flashing blue or blue & red lights or siren.

Demand the driver state:
Full name, Add, DOB, Occ, Ph.
Whether they are the owner of the car
Name and Add for the owner (within their knowledge)

114(6): POA for failing to stop or provide details.

A

Power to suspend licence for 28 days:

BrAlc over 650mcg Alcohol/Litre breath.

BlAlc over 130mgm Alcohol/100ml blood.

BrAlc over 400mcg Alcohol/Litre breath AND two previous convictions for and ‘relevant offence’ within 4yrs

BlAlc over 80mgm Alcohol/100ml blood AND two previous convictions for and ‘relevant offence’ within 4yrs

Failed or refused blood test under Sect 72 or 73 of LTA:

  • At request of Enforcement Officer or Medical person.
  • At hospital
  • Two previous convictions for and ‘relevant offence’ within 4yrs.

Drove a vehicle 40kph over permanent posted speed.
(Speed cameras don’t apply).

Drove a vehicle 50kph over any limit other than permanent one (temp speed, towing speed etc)
(speed cameras don’t apply).

Disqualified drivers.

Suspended or revoked licence.

Not holding a licence AND previously forbidden to drive.
