Freedom of expression
Right of Americans to freedom of speech, of the press, peaceful assemble, petition for a redress of grievances
McCarthyism
Charges unfairly/dishonestly tarnish motives, attack patriotism, or violate rights of individuals (especially to political opponents)
Freedom of religion
Government can’t make any law respecting an establishment of religion or hindering the exercise of religion
Prior restraint
Press is guaranteed freedom from censorship - but the government can punish the press for libelous or obscene material
Clear-and-present-danger test
Government can’t pass a law restricting speech
But it can punish harms done by speech
Due-process clause
Protection against arbitrary deprivation of life, liberty, or property
Libel
Written statement falsely injuring the reputation of someone else
Symbolic speech
An act showing a political message
Free-exercise clause
Laws cannot be made prohibiting the free exercise of religion
Establishment clause
Laws cannot be made respecting an establishment of religion
