Wantonly or unreasonably do or omit any act causing unnecessary suffering to any animal.

Why Legislation may be Ineffective
The legal status of animals as property, exemptions for religious rites, cultural traditions and regional heritage, status and circumstance of the animal, political pressure, different interpretations between courts.
Sometimes not enforce due to international trade agreements, clashes with other legislation and domestic, economic or political pressures.
Purposes of State Acts
Promotes care and use of animals.
Provide standards that balance animal welfare with human interest, allow scientific advancement in animal biology, recognise people’s changing attitudes to animal welfare, protect animals from unjustifiable, unnecessary and unreasonable pain, use for science is accountable, open, responsible.
Duty of Care of Animal
Duty includes provision of food and water, accommodation and living conditions, ability to display normal behaviour, treatment for disease and injury and handling.
Someone is in charge of the animal if they own, license or other proprietary interest in the animal, has custody of the animals, employs, or is within the scope of employment and engagement. Exemptions for duty of care occur if reasonable steps have been taken to migrate effects of special circumstances for example in a bush fire or flood.
