Tell me about juveniles in court
A
- children under age of 10 can’t be prosecuted. Most dealt with at youth courts but serious cases such as Homicide tried at crown court.
- youth court can Impose community punishments, absolute and criminal discharges.
- section 49 of the children and young persons act 1933 gives automatic anonymity. Ceases to apply to avoid injustice, unlawfully at large, in the public interest. Anonymity expires when the juvenile turns 18
- juveniles can appear in adult courts if charged alongside am adult. No automatic ban on identifying the juvenile but courts have discretion to impose a section 39 order. That can mean that the adult can’t be identified either.

- courts can impose orders to ban anti-social behaviour - juvenile made subject to such an order can be identified unless a section 39 order is imposed.
