A
A person does not consent to sexual activity under certain circumstances.
Matters that do not constitute consent.
1) Not protesting or offering physical resistance, use of force or threat of use of force, or fear of force
2)Asleep or unconscious
3) so affected by alcohol/drugs they can not consent
4) so affected by mental or physical impairment they cannot consent.
5) Mistaken I.D
6) Mistaken as to the nature and quality of the act
