On what grounds can a FLOATING charge be challenged? (2)
A
- A gratuitous alienation (actions of a C to put any part of its property out of reach of its creditors who can challenge)
- An unfair preference (where transaction by C has created a pref in favour of a creditor to the detriment of the general body of creditors)
