4th amendment gen rule
Protects the right of the ppl to secure in their persons, houses, papers, and effects, against unreasonable searches and seizures by the government
Elements of 4th
Amendment violation
- conducted by government
- constitutes seach or seizure
- involves person, houses, effect, liberty, and privacy
- is unreasonable
reasonable expectation of privacy two-prong test
- Subjective - person exhibited an actual expectation of privacy
- Objective - the expectation is one that society is prepared to deem reasonable
what is curtilage?
The area immediately surrounding the home
Case by case determination based on ToC
factors to determine where land is curtilage
- the areas proximity to the home
- whether it is enclosed
- the nature of the use
- the precautions taken to exclude others
Is phyiscal intrusion onto curtilage a search?
YES
when is use of sense-enhancing technology a presumptively unreasonable search?
- Gov uses a device that is NOT IN GENERAL PUBLIC USE
- to explore the DETAILS OF THE HOME
- that would have PREVIOUSLY BEEN UNKNOWABLE without physical intrusion
what is probable cause
a quantum of likelihood
requires SUFFICIENT LIKELIHOOD
fair probability, substantial chance, or substantial basis
when is probable cause required
all warrants and all arrests
some warrantless searches and seizures, if supported by PC will be reasonable
Warrant Requirements
- PC
- Oath or Affirmation
- Particularly describing place or thing to be search or seized
- Properly Executed
PC & Warrant Req to search
Need WARRANT and PC that:
- smth than can be properly subject to search or seizure by the gov
- presently or will be there in the future
- in the specific place to be searched
Staleness
Concerns whether the item can “PRESENTLY” be found at a certain location. Related to the passage of time, but time alone is not dispositive. Applies to SEARCHES, but not to arrests.
Exclusionary Rule
This reliable evidence, obtained on the basis of probable cause, will be excluded from the ∆’s
trial pursuant to the 4th Am EXCLUSIONARY RULE, absent some exception to the Rule.
