The Children’s Act 1989

A

Key points;
The welfare of the child is considered paramount (the most important thing) in any decisions relating to them. KNOWN AS THE PARAMOUNCY PRINCIPLE.
Wherever possible the child should be cared for and brought up in their own home.
The parent of the child in need should be given support and guidance to help them care for said child.
Children in danger should be kept safe and protected by effective intervention.
Parents continue to have parental responsibility even when the child no longer lives with them and will be kept informed about decisions made on behalf of the child.

The Mental Health Act 1983

A

Key points;
The Mental Health Act lays out the rules for compulsory admission to hospital if a persons mental health poses a risk to them or people around them.
Most service users are informal (voluntary) patients who have the same rights as anyone else.
Informally detained patients do not have the same rights.
The sectioning process can only be carried out by qualified psychiatrists or in limited circumstances a registered mental health nurse whose rights to detain an individual must be supported by an approved social worker.
The act limits the length of time a person can be detained and gives patients the rights to appeal against their detention.

Disability Act 1998

A

Key points;
Prevents unfair treatment of people due to their disability in the work place.
Ensures everyone has the same chance.
However if the person is physically incapable of doing the job in question as a result of their disability they can be excluded.

NHS and Community Care Act 1990

A

Key points:
Everyone who requires services has the right to a full assessment of their needs and to be fully involved in that assessment.
Everyone assessed who is eligible has the right to expect that the services they receive are tailored to meet their needs where reasonably practicable.

Equality Act 2010

A

Key points;
The Equality Act 2010 legally protects people from discrimination in the workplace and in wider society.
It replaced previous anti-discrimination laws with a single Act, making the law easier to understand and strengthening protection in some situations. It sets out the different ways in which it’s unlawful to treat someone.
