When a court appoints a conservator to manage the property of an incapacitated person

A conservator may be appointed if the court finds:

- clear and convincing evidence that person is unable to manage property and business affairs because of an impairment in the ability to receive and evaluate information or make decisions
- preponderance of the evidence that person has property that will be wasted unless management is provided or money is needed for care, health, education, support or welfare of person
