Types of Tax Authority

  1. Internal Revenue Code - primary source of all tax law
  2. Treasury Regulations- another source for tax law (explain law but not law itself)
  3. Revenue Rulings and Procedures- administrative interpretation- may be cited as precedent
  4. Congressional Committee reports - indicate the intent of congress - not used as precedent
  5. Private Letter Rulings - apply to a specific taxpayer in a particular situation
  6. Judicial Sources- court decision interpret law or facts

A

Substance of the transaction and not form or type governs. IRS ignores legal formalities.

example- sell property owned by XYZ to ABC (owned by same person)

Step Transaction

A

Ignores individual transaction and taxes the ultimate transaction. Interdependent transactions.

Penalties

A

Frivolous Return - omits information, incorrect tax, desire to impede tax - $5000

Negligence- disregard of rules without intent to defraud. 20% penalty portion of underpayment. Includes failure to keep adequate books and records.

Fraud- intent to cheat. Penalty 75% of underpayment. ( on original deficiency, not interest)

Failure to pay above .5% per month - max 25%
Failure to file- 5% of tax due each month max 25%
