65
Q

Aaron is picked up by a mate. The ignition barrel is broken. He SUSPECTS that the car is stolen. He doesn’t ask any questions. The car doesn’t move before police surround the car. Is Aaron guilty of being carried TWOC?

A

The person who commits this offence must know that the conveyance has been taken without the consent of the owner or other lawful authority. If that person only ‘suspects’ that the conveyance has been taken, the offence is not committed.

Further, the conveyance must actually move when the person drives it or allows themselves to be carried in or on it.

66
Q

EVANS fancied CATHCART, who worked with him. He asked her out during a Christmas party, but she refused as she was married. The following day, EVANS sent CATHCART an email, stating that, unless she had sex with him, he was going to phone her husband and tell him they were having an affair.

Has EVANS committed the offence of blackmail in these circumstances?

A

Blackmail is committed when a person, with a view to gain for himself or another, or with intent to cause loss to another, makes any unwarranted demands with menaces (s. 21 of the Theft Act 1968). Under s. 34 of the Act, ‘gain’ and ‘loss’ mean to gain or lose in money or other property. It will not apply where a person is making demands for sexual favours (no ‘menace’ has been made.

Violence is not required in the demand.

no fear on the part of the victim is needed - the offence is complete at the moment the demand is made.

67
Q

EYRES uses his bag and the hammer in it to give the impression that he has a gun, and it certainly looks like he has got a gun in the bag. Is it an aggravated burglary?

A

it must be shown that one of the defendants who actually entered the building or part of a building had the weapon with him/her (R v Klass [1998] 1 Cr App R 453). This is not the case and a hammer only becomes a weapon of offence or imitation firearm when it is used as such

Q

Is a trademark property that can be stolen?

A

Yes

69
Q

I let next doors dog out to escape as i know the dog was being abused. I believe it was the right thing to do. Is this theft?

A

to attribute dishonesty on the basis of the moral beliefs of the defendant would be unsound. The test is whether, according to the ordinary standards of reasonable and honest people, what was done was dishonest and if it was, whether the defendant realised.

70
Q

Can people that live in their vehicles ever be guilty of going equipped if they have items used for going equipped inside?

A

Yes when it is being driven and it is stopped- it is not a place of abode anymore. If it was in a lay-by or stopped in car park - place of abode and no offence.

71
Q

Is it still going equipped if you possess items that have been used for TWOC if you don’t have intention to use them again?

A

the items must be for a “future use not one in the past”

72
Q

73
Q

If someone brings fireworks on a burglary, have they committed an agg burglary?

A

74
Q

A burglar brings some drugs for a guard dog to be incapacitated. Agg burglary?

A

No - it must be any article, made or adapted or intended for causing either injury or incapacity

TO A PERSON

75
Q

Is giving someone an empty box with bomb written on it an agg burglary?

A

It does not constitute an explosive but it does constitute a weapon of offence if the burglar gave it to the security guard and said, if you move it will explode. As it has incapacitated someone

76
Q

What is the key thing to remember about force towards a third party in a robbery?

A

Force can be used against a third party immediately before the theft if it was used to facilitate it.

However if it is a threat of a force, the suspect must intend for the recipient of the threat to be placed in fear of force being used against THEMSELF. You cannot fear for someone else’s safety. It is blackmail.

It is irrelevant whether the person was actually in fear. It is about the suspect’s intention.

Force must be then and there and not future otherwise it is blackmail.

77
Q

If a delivery driver uses the van to take his child to school, is it TWOC?

Yes - entirely different purpose

78
Q

Can you TWOC a car that doesn’t have an engine?

A

No - the purpose was to wind Jamie up not to enable me or another to be carried.

80
Q

A

It is summary but

6 months from the date of a certificate confirming that sufficient evidence has come to the knowledge of the prosecution but no later than 3 years after the offence was committed

81
Q

What is the difference between the type of vehicle for agg TWOC and TWOC?

A

Agg TWOC is narrower - must be an MPV whereas TWOC is just a conveyance.

82
Q

What make a TWOC aggravated?

A

MPV (not conveyance like normal TWOC) was driven dangerously on a road or public place

Or

Injury or damage caused by either an injury accident to ANYONE
A damage accident to any property
Damage to vehicle taken

83
Q

If someone TWOCs a car from a supermarket car park and drives it dangerously round a supermarket car park before dumping it in the same car park, is it agg TWOC?

A

Yes - road or public place

84
Q

What if someone damages the vehicle to get in and TWOC it. Is it now agg?

A

No - it must have occurred after TWOC has been committed and before the recovery of the vehicle.

85
Q

What are the two defences to aggravated TWOC?

A

Any of the 4 consequences happened before the TWOC took place.

The suspect was not in the IMMEDIATE VICINITY of the vehicle when the consequence occurred. This is a question of fact for a jury.

86
Q

Is it know or believe the goods were stolen for handling?

A

Both - it must be know or believe - suspect is not good enough

87
Q

Can we use a suspects previous conduct when considering whether they knew or believed goods were stolen for handling?

A

Yes

If they have within 5 years been CHARGED or CONVICTED of either theft or handling.

And in the last 12 months before the offence charged they were found in possession of stolen goods or they undertook the removal etc

88
Q

CRUCKSHANK is the victim of a burglary. he persuades ZANDER, the owner of a local newsagent shop, to place an advert in the front of the shop asking for the photographs to be returned. The advert promises that CRUCKSHANK will ask no questions about the burglary as long as the photographs are returned.

A

No - no money has been offered.

89
Q

where can a vehicle interference take place?

A

Any location - public or private.

90
Q

Suspect threatens a blind/deaf man with a knife saying to give him his phone. Blind/deaf man isn’t in fear and doesn’t realise what is happening. Suspect walks away empty handed. Does he commit attempted robbery? No full robbery as no theft.

A

Yes - he sought to put the victim in fear. It doesn’t matter that the victim was never actually in fear.

91
Q

What is the max sentence for burglary non-dwelling?

A

10 years

92
Q

What is the price limit for fixed penalty notices for theft?

A

£100

Offences of theft from businesses (classed as ‘theft from a shop’) involving values not exceeding £100 can be dealt with by way of fixed penalty notice.

93
Q

Can you have a vehicle interference on a dumper truck?

A

Vehicle interference only relates to interference with motor vehicles or trailers. A dumper truck is not a motor vehicle as it is not intended or adapted for use on a road; it is a mechanically propelled vehicle but that does not form part of the definition of the vehicle interference offence.

94
Q

What vehicles can you ‘interfere’ with?

A

Motor vehicles and trailers only. Not MPV’s.

95
Q

Police come across a garage full of stolen property and mount surveillance. Given the goods are now in the possession of police, can handling ever be committed?

A

When police officers recover stolen property and then wait for it to be collected by a handler, the offence can still be made out if the arrangement to handle stolen goods is made “before” they were reduced into lawful possession and while they were still ‘stolen’ (see Houghton v Smith [1975] AC 476).

96
Q

Considering the law in relation to ‘appropriation’, can you commit theft if the victim consents to the appropriation? E.g elderly person

A

Yes

Their Lordships ruled that: • in a prosecution for theft it was unnecessary to prove that the taking was done without the owner’s consent (making answer A incorrect) • it was immaterial whether the act of appropriation was done with the owner’s consent or authority (making answer D incorrect). Answer B is incorrect as this ruling means that, even where the property has been given as an absolute gift, there can still be appropriation.

97
Q

For the advertising a reward offence, if the person believes they lost it but still go on to advertise a reward with a promise that no questions will be asked or that immunity will be granted, do they commit the offence?

A

Yes - the fact that the advertiser is confident that they were lost is irrelevant. The legislation prohibits adverts which combine an offer of a reward with a promise that no questions will be asked or that immunity will be granted.

98
Q

If someone enters a building as a trespasser unknowingly with a WIFE, could they commit an agg burglary?

A

No they must know

99
Q

A

Yes

100
Q

Suspect steals a thousand from a house. He puts it in his bank. He then transfers it to a friend. In relation to dishonestly retaining a wrongful credit, who has committed the offence?

A
