What is a reportable death?

A

Section 6 Coroners Act 2009 ‘Reportable Death’

1) Violent or unnatural death
2) Sudden death, cause of which unknown
3) Suspicious or unusual
4) Not seen a doctor for 6 months
5) Not the reasonable expected outcome of a health related procedure
6) In or temporarily absent from Mental Health Facility

What other Sections of the Coroners Act 2009 are relevant to Police

A

Section 40 - Coronial Investigations Scene Order

  • Need to prove matter is reportable to the coroner
  • Obtained by writing or telephone
  • Need to specify any other persons who need to be authorised on the warrant

Section 43 - Coronial Investigation scene powers

Section 53 - Power to obtain documents (medical records)

- If during inquest coroner is of the opinion evidence is capable of satisfying a jury beyond a reasonable doubt
