Invasion of privacy Flashcards

Q

Is publishing facts about individual to the public an invasion of privacy?

A

An action for the invasion of privacy based on the public disclosure of private facts is grounded in the disclosure of truthful information about the plaintiff that is not of legitimate concern to the public and that a reasonable person would find highly offensive.

By contrast, an action for the invasion of privacy based on the publication of facts placing her in a false light can be maintained if the tort of false light is recognized in this jurisdiction as it is in the majority of jurisdictions and the individual shows that the publisher made public facts about her that a reasonable person would find highly offensive, and which placed her in a false light, she will prevail.
