Define consent?
is the owners formal agreement to the medical or surgical course of action proposed which should ideally also include acknowledgement of an estimate of associated costs
how can consent be given/expressed?
implied, verbal and written - all valid by law
written consent is preferred as a form of evidence though a signature doesn’t = valid consent it just indicates that a interaction took place between the professional and owner.
what are the requirements of valid consent?
Competence - can they retain the information? believe it?
sufficient age and maturity
capacity -mental capacity to make own decisions.
what four things does the law state that someone lacking mental capacity cannot do>?
understand info given to them
retain that info long enough to be able to make a decision
weigh up the information available to make a decision
communicate their decision
