What is the difference between a latent and patent defect?

A

Latent - one that could not have been easily or reasonably identified through inspection

Patent - a defect that should have been visible at the time of inspection and recorded - I.e a crack in brickwork

What is the purpose of a schedule of condition?

A

To qualify the extent of the tenants repairing obligation

- not obliged to put in a better condition than that stated in the SOC

How should a SOC be documented?

A

When relying on a SOC this should be expressly referenced in the body of the lease.

There should be clear photographic evidence with as much detail on the condition as possible. Clear photographs should also be taken.

What are the limitations of a SOC?

A

The extent of repair is limited whereas under an FRI lease the tenants statutory repairs cover those that were not obvious at the time of inspection, such as latent or inherent damage.

A

To tenant - reduces cause of disputes. Makes obligation for repair clear.
