Q

Woolmington v DPP

A

D threatened to commit suicide to his wife. He pulled out a loaded shotgun to show he meant it.

As he brought it out, somehow the gun went off and killed he wife. He claimed this was a pure accident.

The burden of proof was put on the defendant to prove the defence, the HoL held this was incorrect.
