When is neighbor liable to landowner for damages caused by neighbor’s excavation on his own land?

A

Owner’s land
- If Neighbor causes subsidence towards Owner’s land => Neighbor is ‘strictly’ liable

Owner’s land with buildings

  • If Owner’s land would have collapsed in natural state (with NO buildings) + Neighbor causes damage towards Owner’s land => Neighbor is ‘strictly’ liable
  • If Owner’s land would NOT have collapsed in natural state (due to buildings) + Neighbor causes damage towards Owner’s land BUT Neighbor was negligent => Neighbor is ‘negligently’ liable

  • NOT unreasonable interfere with another’s riparian rights
