What is the Crime Control Model?
Main aim = suppression of crime to maintain order.
- there priorities is to catch and punish offenders, and both deter and prevent them from committing crime.
- there is a presumption of guilt and they focus on protecting the rights of victims.
- they seek a quick and efficient disposal of criminal cases, similar to a conveyor belt.
- they have a zero tolerance approach to crime and police have enhanced powers.
What is the Due Process Model?
Main aim = protect the accused from oppression/abuse of the state by state agencies.
- focus on the presumption of innocence and innocent until proven guilty.
- the system must safeguard the rights of an accused individual to prevent a wrongful conviction.
- the police should have limited powers to prevent official oppression.
Which criminal justice system rules favour Crime Control?
- restriction on the availability of legal aid
- extended police detention is allowed for questioning and suspicion of indictable offences and terrorist offences.
Which criminal justice system rules favour Due Process?
- the suspects rights to know they are being arrested
- all police interviews are recorded
