Duties of Pic

A

-responsible for the safe operation of the aircraft in flight, the safety and wellbeing of the crew and passengers and cargo
-have final authority to control the aircraft while in command and for the maintenance and discipline of all persons on board
-Be responsible to compliance with the regulations (subject to section 13 of the act)

-power to control/restrain/off load or to reject passengers
-power to authorize other crew to control/restrain

When can a Pic breach a regulation

A

In an emergency when:

-the emergency involves danger to life or property
-the extent of the breach only goes as far as necessary to deal with the emergency
-there is no other reasonable means of avoiding the emergency
-it is more dangerous to not deviate from the rule.

Pic must notify director of any breach ASAP and provide a written report if requested.
