What is WAC testing and what does it stand for?

A

Waste Acceptance Criteria testing. It determines which landfill a waste material can be safely disposed of in by determining it leachability. it does not classify the soils.

When did you decide that it was a legitimate variation?

A

It was a legitimate variation because the Contractor clearly clarified that they would not take the risk on adverse soil conditions if the classification provided within the documents was incorrect therefore the risk sat with the client.

WAC testing confirmed that despite the soil being non hazardous it was contaminated enough to not be accepted and your non haz landfill sites so the issue was the inadequate identification of the initial classification report.

In regard to your other issue procurement in a difficult market… How does D&B reduce preconstruction time… but there still needs to be a period for design.

A

The design and construction can overlap which means a faster start on site. There was still a period of design to begin initial works but this could be started under a PCSA while the demolition contract was on site and finishing up.

Who does the design, when does it get done.

A

Design team completed the design to RIBA design stage 3- spatial coordination it is then tendered and the chosen Contractor continues the design on from there. It began while demolition was still on site under a PCSA, other design would continue to be developed as the works progressed.

Why did you split the works and do Traditional for the Demolition and D&B for the main works.

A
  • Splitting the works meant we could get on with Demolition and complete the tender process/ get the main contractor designing under a PCSA.
  • The demolition was specific in that it needed to be demolished specifically and safely so having the design team fully specifying what is required felt the best option.
    -By keeping them in the same contract it would add an extra dimension onto the Contractors skills and abilities. We would need not only a main contractor with strong D&B experience and high quality experience of completing new build care facilities but also demolishing a car site safely. Why not get a demolition contractor with lots of experience.

A

Novation is the transfer of legal obligations, one point of responsibility to the Contractor. Contractor risk through novation agreement. Legal implications and responsibility of design sit with the Contractor.

A

They would have assessed the type of transport required sealed roll on roll of trucks, typically more expensive and require a trained professional in handling haz material.

The location of the hazardous site typically further away.

Landfill tax is higher- for haz is £126 per tonne.

Where as for non haz its £4 per tonne.

A

Reviewed the rate via pricing data via BCIS.

Reviewed whether it was reasonable for the location of the landfill site, the landfill tax allowance, the quantity of trucks required can hold 15-30m3 of soil per truck so about 5 trucks required.

You mentioned about use of different piling options displacement piles would this be realistic?

A

In reality on this site perhaps not, displacement piling compacts the surrounding soil this was a confined site with lots of piles i suspect there is only so much compaction that can be done and it may cause issues to the neighbouring foundations.

How did you approach programme time for investigation on the different options?

A

With the Contractor we assessed the programme and established how much time there was to make a decision without it causing delay to excavation and piling and basement it was imperative to not cause delay. Ultimately finding a speaking with a specialist involved a few meetings so did not delay the programme but a solution for disposal was found.

The client is not obliged to make advanced payments.
If the client is considering it to support cashflow they safest way to do so is through an advanced payment bond.
If not the money will be at risk if the contractor goes insolvent.

Change control procedure? What to be aware of?

A
  • Under JCT there is not formal change control procedure identifying however i think its important to have one in place. Typically I would have a change identifying the contractor to provide a price and this then either instructed or not.

However, change control can slow things down, this can be sped up by not necessarily agreeing the cost works can proceed without being priced but ideally having a budget cost is beneficial.

Is the contractor obliged to offer a price for a variation ?

A

Yes if specifically instructed to offer a price than the contractor is obliged under schedule 2 quotation.
The contractor can object within 7 days of confirm and has 21 days to provide a price then the client has 7 days to confirm or deny.

What is SUDS and how does it differ?
- Sustainable urban drainage systems - Mimics the natural drainage process - Aim to manage surface water run off and ultimately reduce flooding by slowing down unlike traditional systems the removal is fast which creates flooding. Examples- Soakaways, swales, permeable paving.

- Soakaway- water collects in attenuation tank and the soakaways slowly disperse the water into the ground. - Swales - channels that collect the water - Permeable paving that allows the water through to the ground.

- Lead is incredibly strong, durable and weather resistant - Lead is graded in relation to its thickness. - Grade 5 would typically be used for flat roofing as it is stronger to combat water pooling. - Timber rolls are used to create a surface for the lead to fasten to, and allow for the natural expansion and movement of the lead sheet. - Timber rolls support water run off and prevent the water seeping under the lead.

When PC is achieved the Employer should issue s PC certificate. If the contractor ahs failed to complete the employer must issue a non completion certificate. If LADs are required the employer must notify the contractor.

- Yes the contractor must comply with all instructions. -The contractor has a right to reasonably reject under their CDM responsibilities and must notify the client that the change is not compliant. -If within 7 days of an instruction the contractor does not comply the client can hire someone else to complete the work and the contractor will be liable.

The contractor must confirm it in writing with 7 days.

- If failure to pay following 7 days of the final payment date the contractor has the right to suspend works.

I would value the works anyway it is my responsibility to value the works and a payment notice must still be issued.

The client is not obliged to issue a payment notice and the payment dates are only triggered by the application.

What happens if the contractor issues an application and no payment notice has been certified.
The contractor should issue a default payment notice and will be entitled to the full amount. A payless notice can still be issued to amend this but must be done no later than 5 day before the final date for payment.

-Following PC the contractor must issue their final statement including adjustment to contract sum and all supporting documents. - This must be issued within 3 months of PC. - If this is not issued within 3 months, the client will give a 2 months notice for issue and will issue their own statement at the end of this period. In reaching an agreement I would discuss parameter of agreement with the client and bring supporting documentation of my position to reach an agreement.

- L&E is only allowed if EOT for a relevant matter has been given. - L&E needs to be ascertained its not enough to go back to the contract in needs to be accurate of the additional expenses incurred by the contractor and they must provide supporting information from the point of delay. - For a smaller scale project you make make an assessment on prolongation of prelims.

Ok so what if the client is putting pressure on you to issue PC what would you say?
- If building control is not issue i would say no as you would not be able to insure the building. - I would like to see that O&Ms are in progress, H&S files are in progress and that some information like testing certs can be handed over.

Can you explain the advise you gave for material off-site on Glen Lodge.
Yes so there was no listed items within the contract for material offsite, so the client was not obliged to pay. However the client was considering payment to support the contractor as their was no room for the joinery to be held on site and materials need to be procured in accordance with the programme. I advised the while you are not obliged if you are considering this I would ensure a vesting certificate which transfer the ownership into your name, that the materials are insured and clear labelled/ identified for ownership. Without this their is a risk if the contractor goes insolvent that the material will be taken as theirs and money would be lost. I have had experience where contractor issue vesting certificate with ownership in their name rather than the subcontractor so its important to check vesting certs are in the clients name!

How would you select the appropriate contract for a project?
I would identify where we wanted the risk and responsibility to site for design and work. I would asses the value and which contract is most appropriate. The scale and complexity of the job, for example if is your standard work packages intermediate may be appropriate however if their is more complex supply chains.

Can you explain some other forms of contracts and how they differ?
I am aware of NEC. I understand that unlike JCT NEC identified a specific change control procedure where by changes are called compensation event and a contractor advised on cost and time impacts which differs to JCT. -Contractor also issues and programme on a monthly basis.

What is your view of bespoke contracts and amendments?
- Not necessarily supported by case law, uncertainty if hold up in court. -JCT means joints contract tribunal and representative of different parties within construction so is fair. Amendments are changing that.

Are you aware of any case law?
Yes I am aware of the case between Ardmore vs BDW. BDW identified fire safety defects and Ardmore had to pay 14m in damages. - this was important as even though it was after the BSA they could still be prosecuted.
